Mr. Delatte was diagnosed with mesothelioma at just 52 years of age. A
proud father of two children, Mr. Delatte was a life-long union
boilermaker who worked at various shipyards and plants throughout
Louisiana. After Mr. Delatte was diagnosed with mesothelioma, his life
was never the same. He was forced to quit his job and give up things he
once loved, such as fishing and gardening, and he was so sick that he
could not even watch his daughter cheer at football games. After sharing
one final Thanksgiving meal with his family, he passed. Mr. Delatte’s

Mr. Rando, a resident of Metairie, was exposed to asbestos through his

An Introduction to Asbestos and Mesothelioma
Asbestos is a deadly mineral that has been used in thousands of
products. When microscopic asbestos fibers are inhaled or ingested, they
can cause a number of diseases, including mesothelioma cancer. Of the

we’ve seen what happens to an individual that has mesothelioma… and what
it does to a family.
I’d like to take 2 minutes of your time and tell you about Diana – a
wonderful woman who contracted mesothelioma – and how we helped both
her, and her family.
When Diana was 33, she was diagnosed with Mesothelioma,
a disease that would eventually kill her. When she learned that she
had Mesothelioma, Diana knew she had a poor prognosis because she was a
nurse that worked with Cancer patients, and had seen this disease and
what it does to people.
She knew that Mesothelioma is a form of cancer, caused almost
exclusively by being exposed to asbestos fibers, and that it attacks the
pleura, which is the lining of lungs.
A person with Mesothelioma has to struggle and fight for every
breath. And to make matters worse, this cancer will often invade other
parts of the body as well.
Diana knew that there was no cure, and that it is horribly painful and is always fatal.
I was first introduced to Diana through her Mother. Our law firm was
already working with the family in pursuing a mesothelioma claim
for Diana’s father, who had passed away after being diagnosed with
asbestosis and lung cancer because of his exposure to asbestos.
After we were told that Diana had been diagnosed with Mesothelioma, we made arrangements to fly to Las Vegas, where she now lived.
When Diana opened the door at her home, I was shocked. I was so used
to seeing the horrible effects of mesothelioma on the people we help.
But she appeared as a striking and healthy young woman.
We sat down at her kitchen table where her two youngest children were
eating a snack. Our meeting was like a normal meeting, but I had to
keep reminding myself that I was talking to a young woman who had been
diagnosed with terminal cancer.
Given that her Dad had died from exposure to asbestos,
it wasn’t hard to determine how Diana got mesothelioma. Her Dad worked
as an asbestos insulator, and had also worked with asbestos at the Dow
Chemical Plant in Plaquemine, Louisiana.
And every day, he came home to his family with asbestos dust on his
clothes and body. Once he got home, he did what most fathers do; he
hugged his kids or played with them.
Unfortunately, while engaging with his children, asbestos fibers
would be released into the air, and his kids breathed in the tiny
asbestos fibers.
And in the evening, Diana’s mom would wash her husband’s clothes.
But before she did, she would shake the dust from them before she threw
them in the washing machine. Every time that happened, asbestos fibers
again filled the air.
Our first meeting in Las Vegas lasted 2 hours. And even though Diana
understood this disease, and knew what the end result was going to be,
she did not cry.
She was very strong, and she wanted us to pursue a lawsuit on her behalf so her children would have a future after she was gone.
Like most people with mesothelioma, she had a lot of questions, such as:
* What did she have to do if a mesothelioma lawsuit was filed?
* How long would a lawsuit take?
* Is a mesothelioma lawsuit usually settled out of court or will it go to trial?
I also asked her many questions as well so we could quickly file the lawsuit on her behalf.
We spoke on the phone several times a week and, over the next 18 months, we traveled to her home in Las Vegas three more times.
On our last visit, Diana only weighed 80 pounds, couldn’t sleep,
couldn’t eat, and the tumor had grown so extensively it appeared as a
horrible rash all over her body. She had also lost all of her hair
because of the chemotherapy and radiation treatments.
Because we spoke with Diana so much, it was no surprise that I became
very close to her during this time. I also became friends with Diana’s
fiancé, her ex-husband, her sisters, and her co-workers.
Pursuing Diana’s mesothelioma lawsuit was difficult because her father
had died before we had a chance to talk to him about where he had worked
over the years.
He hadn’t kept any of his employment records, so I had to recreate
his work history – which was no easy task because, as an asbestos
insulator, he worked hundreds and hundreds of small jobs which lasted
from a few days to a year or more.
So I had to re-create his thirty year career from scratch. To do
that, I had to track down his old co-workers and employers at night and
on weekends to get the information we needed. And I traveled all over
the country to depose his co-workers and former employers.
The case took about a year and a half to complete. We settled for a very large sum, which was put aside for Diana’s three children.
Diana passed away shortly after the settlement was reached…. and I
will never forget the courage she showed in facing this disease.
