Asbestos has not yet been banned in the United States. Its use is regulated, but it is still used in products today. EPA Superfund Cleanup

The U.S. EPA has cited one Minnesota location for asbestos contamination in its Superfund program for hazardous waste cleanup: the Western Mineral Products Site in Northeast Minneapolis. According to EPA documentation, the industrial property was purchased in 1963 by W.R. Grace Co. to manufacture vermiculite insulation. The asbestos-heavy vermiculite came from the famous Libby, MT vermiculite mines that were operated by the same company. The former facility, which operated for 50 years, used to freely offer piles of waste rock to local residents, who may have used it for numerous household applications. The industrial property’s current owners are participating in a voluntary cleanup, and the EPA has cleaned up roughly 260 area homes identified as having “Libby asbestos.”1,2 In 2008, the EPA also tested the air in those homes for asbestos fibers.3

"[I]t is the occurrence of 'some' damage, and not 'the ability to ascertain the exact amount of damages,' that triggers the accrual of a cause of action and running of the limitations period. MacRae v. Group Health Plan, Inc., 753 N.W.2d 711, 719 -720 (Minn. 2008).
